We strive to only collect and use personal information that we need. We may update this Privacy Policy from time to time, as detailed below. Notice at Collection:

We may collect or process various categories of personal information. The section directly below titled “Personal Information We Collect” contains information on the categories of personal information collected, the purposes of why it is collected, and whether we sell or share personal information. As an overview, we collect identifiers, commercial information, internet or other electronic network activity information, sensitive personal information, biometric information, and inferences drawn from personal information.

We do not sell your personal information but may use and share such information as described below. However, to limit the use of your sensitive personal information, you can contact us through the methods provided in the “Contact Us” section at the end of this Privacy Policy.

We may also use information collected to comply with applicable laws, respond to law enforcement requests, and to exercise or defend the legal rights of STIIIZY and its employees, customers, contractors, and others.

How and For What Purposes STIIIZY Uses Non-Personal Information:

We also collect information in a form that does not, on its own, identify any specific individual or household and could not reasonably be linked, directly or indirectly, with a particular individual or household (non-personal information) such as aggregate data and information about activity on the Websites.

We may collect, use, transfer, and disclose non-personal information to improve the Websites and customize the user experience, and for any other legitimate purpose. We also may aggregate non-personal information to track trends and analyze use patterns on the Website.

This Privacy Policy does not limit our use or disclosure of non-personal information and we reserve the right to use non-personal information and disclose it to our partners, product manufacturers and other third parties at our discretion (including aggregated and/or anonymized information about our users and their use of the Websites).

If we do combine non-personal information with personal information, the combined information will be treated as personal information for as long as it remains combined.

Online Tracking:

STIIIZY uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”) to assist in delivering the Websites. This service helps us better understand who and how people are using the Websites and how to improve the effectiveness of the Websites. Google may use cookies, pixel tags or other technologies to collect and store anonymous information, such as time of visit, pages visited, time spent using the Websites, type of operating system used, and other website(s) you may have visited. Cookies help us better understand user behavior including for security and fraud prevention purposes, parts of our Websites that have been visited, and the effectiveness of advertisements and web searches.

You may refuse the use of cookies by selecting the appropriate settings on your browser. However, please note that if you refuse the use of cookies, you may not be able to access the full functionality of the Websites.

Sharing Information with Other Parties:

We may employ service providers or individuals to facilitate our provision of the Websites, to provide the Websites on our behalf, provide customer support, perform service-related services (e.g., maintenance services, database management, web analytics and improvement of features) or to assist us in analyzing how the Websites are used. These third parties may have access to your personal information, but only to the extent needed to perform these tasks on our behalf, and we will contractually require them to protect and safeguard your personal information in accordance with applicable laws.

If you choose to purchase merchandise, products and/or services, on or through features on the Websites, our service providers may collect your personal information (such as credit card or other payment information) for payment processing, order fulfillment, credit pre-authorization, and address verification. Our service providers are obligated to handle personal data consistent with this Privacy Policy and according to our instructions.

Messaging:

By providing your mobile phone number and/or email address through the Websites, you expressly consent to receive informational and transactional messages at the mobile phone number provided to STIIIZY, including with use of messages, and texts (including, but not limited to, short message service (SMS) text messages), and/or emails at the email address provided to STIIIZY. Consent is not required as a condition of your use of the Websites. Message and data rates may apply. Please contact your carrier for more details. You may opt-out of receiving these messages at any time. SMS opt-in and phone numbers collected for SMS consent will not be shared with any third party and affiliate company.

Others:

It may be necessary for STIIIZY to disclose your personal information by law, legal process, litigation, and/or requests from public and governmental authorities. We may also use and disclose information about you if we determine that use and disclosure is reasonably necessary to enforce our terms and conditions or other rights, or to protect the Websites or its users. This could include providing information to public or governmental authorities.

Additionally, in the event of a reorganization, merger, or sale of all or a portion of our business, we may transfer all personal information and non-personal information we collect to the relevant third party. If transferred in such a case, your information would remain subject to this Privacy Policy or a privacy policy that, at a minimum, protects your privacy to an equal degree as this Privacy Policy.

Protecting Your Personal Information:

STIIIZY implements security measures designed to protect your information from unauthorized access, disclosure or accidental loss or destruction. We utilize appropriate physical, technical and managerial safeguards designed to protect the information we collect. All transactions are processed through our gateway provider Shopify and are not stored or processed on our servers. For additional information about Shopify’s practices, please see [LINK].

STIIIZY’s physical infrastructure is hosted and managed within Amazon’s data centers located in the United States and utilize the Amazon Web Service (AWS) technology. For additional information about Amazon’s practices, please see [LINK].

By using the Websites or providing personal information to us, you agree that we can communicate with you electronically regarding security, privacy and administrative issues relating to your use of the Websites. If we learn of a security systems breach, we may attempt to notify you electronically, so that you can take appropriate protective steps, by posting a notice on the Websites and/or sending an email to you at the email address you have provided to us. Depending on where you live, you may have a legal right to receive notice of a security breach in writing.

Your Privacy Rights:

You can make certain choices about our collection and use of your information. You can control certain personal information that STIIIZY obtains and exercise your data protection rights (which may vary depending on the jurisdiction), by contacting STIIIZY or using various tools we provide. For example, you can:

Use the “unsubscribe” links contained in our email messages to stop receiving product or promotional offers from us via email.
Opt-Out of messages sent to your mobile device.
Prevent the Website from obtaining your location (e.g., disabling location services on your device.) However, doing so means your use of certain features of the Website will be limited.

Not all personal information processed by STIIIZY can be accessed or controlled via the tools described above. If you want to access or control personal information processed by STIIIZY that is not available via the tools above, please contact STIIIZY at Privacy@STIIIZY.com.

We endeavor to substantively respond to a verifiable consumer request electronically within forty-five (45) days of its receipt. If you do not receive confirmation within the 45-day timeframe, please contact: Privacy@STIIIZY.com. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.

The response we provide will also explain the reasons we cannot comply with a request, if applicable. We do not charge a fee to process or respond to your verifiable consumer request.

We may need to verify your request before completing it. For example, we may ask you to confirm data points we already have about you. We will only use personal information provided in a request to verify the requestor’s identity or authority.

If you, or an authorized agent acting on your behalf, wish to: (1) make a request related to any of the rights set forth below; or (2) appeal our refusal to act within a reasonable time, please reach out to us using the contact information provided in the “Contact Us” section of this Privacy Policy.

Right to Know or Access: You may have the right to get confirmation about whether your personal information is being processed. If so, you may have the right to access the personal information and other information, such as the business or commercial purposes for collecting, selling or sharing information; the categories of personal information we collect; the categories of sources for personal information; the recipients (or categories of recipients) to whom the personal information have been or will be disclosed or sold, along with the personal information categories that each category of recipient purchased or obtained, as applicable; the predicted period that the personal information will be stored, or, if not possible, the criteria used to determine that period.
Right to Delete: You may have the right to the deletion or erasure of your personal information from our records in certain circumstances. We will delete or deidentify personal information not subject to one of the following exceptions from our records and will request our service providers to take similar action. We may deny your request if retaining the information is necessary for us to:

Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you.

Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.

Debug products to identify and repair errors that impair existing intended functionality.

Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.

Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).

Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.

Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.

Comply with a legal obligation.

Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Right to Correct: You may have the right to correct your personal information if inaccurate.

Right to Opt-out of Sharing: You may have the right to opt-out of the sharing of your personal information to third parties. To exercise this right, you may submit a request by emailing Privacy@STIIIZY.com.

Right to Consent and/or Limit the Use and Disclosure of Your Sensitive Personal Information: You may have the right to consent to and/or limit our use of your sensitive personal information to that which is necessary to perform services, provide the goods reasonably expected, or as authorized under applicable regulations. Right to Nondiscrimination: You may have the right to non-discrimination, and to receive equal service and pricing from a business, even after exercising your rights.

Right to Data Portability: You may have the right to receive the personal information that we collected about you, in a structured, commonly used and machine-readable format.

Right to Opt-out of Profiling: You may have the right not to be subject to a decision based solely on profiling, except under certain exceptions under local law.

Our Policies Concerning Children:

You must be either (a) a valid medical marijuana patient 18 years or older or (b) 21 years or older to create an account on the Websites.

Our Websites are not intended for individuals under 18 years old. We do not knowingly collect personal information from individuals under 18 years old. If you are under 18 years old, please do not provide any personal information to any of our Websites or, through any of its features, register on the Websites, make any purchases through the Websites, contact us through the Websites, or provide any information about yourself to us. If we learn that we have collected or received personal information from an individual under 18 years old, we will delete that information and the associated account. If you believe we might have any information from or about an individual under 18 years old, please contact us through the methods provided in the “Contact Us” section at the end of this Privacy Policy.

Users Outside of the United States:

The Websites and the servers upon which they are hosted are located in the United States and are not designed or intended for anyone outside of the United States. If you are outside of the United States, please do not provide personal information to us. Personal information you nonetheless submit using the Websites or otherwise provide to us will be transferred to and stored in the United States. By using the Websites and providing personal information to us, you acknowledge and authorize this transfer.

Account Information and Keep Passwords Private:

If you create an account or register with our STIIIY Services, you are responsible for maintaining the security of your password at all times. You are responsible for any and all activities that occur while logged into your account.

Changes to our Privacy Policy:

We may occasionally update this Privacy Policy. When we do update this Privacy Policy, we will also revise the “Last Updated” date at the top of the Privacy Policy. If we make changes to this Privacy Policy, we will post the updated Privacy Policy on the Website. Please review this Privacy Policy periodically to stay informed about how we are collecting, using, sharing, and storing information. If you continue to use the Websites after we post an update to this Privacy Policy, you are indicating your acceptance and consent of the updated Privacy Policy.
